Judges who handle traffic cases, like all other jurists, are committed to knowing the law and procedure, but also effectively managing their courtrooms.

Effective courtroom management includes providing defendants with meaningful court access, respectful treatment, a comprehensive explanation of courtroom procedures, an opportunity to be heard, and access to well-resourced counsel. Access to justice has increasingly become the focus in courts across the world and particularly here in the United States. This webinar will focus on the importance of access to justice, and how the principles of Access to Justice are applied in the courtroom, particularly in the handling of traffic dockets, DUI and license suspension cases. It will also address how bail, fines, fees, and costs impact access to justice.

What will I learn?

During this course, you will learn to:

  • Recognize Access to Justice issues that often arise in high volume Traffic Courts whether cases involve jail as a penalty or not;
  • Detect the Access to Justice issues that can arise when determining pretrial conditions including but not limited to ignition interlock systems, SCRAM ankle monitors and drug testing/monitoring as well as how to remedy some of the impediments;
  • Develop ethical and efficient processes that allow for imposing reasonable bail, fines, fees and costs in traffic cases that do not result in impossible legal financial obligations (LFO’s); and
  • Identify potential practical issues when imposing pre-trial conditions in traffic cases.

Series Description:

To effectively and responsibly handle traffic cases, judges must not only weigh evidence and apply legal principles, but also provide meaningful access to the courts for all parties. This program will provide many of the basics for judges new to the bench to identify the issues that arise in handling traffic dockets and the tools to manage their courtroom with respect and with dignity.

Topics to be covered included: the Judge’s role in handling traffic cases, implicit bias and other access to justice issues in traffic cases, controlling the courtroom, impaired driving, toxicology essentials, commercial motor vehicles, and sentencing traffic offenders to reduce recidivism.
