Due to the crisis of gun violence, including suicides and mass shootings, 21 states, the District of Columbia, and the U.S. Virgin Islands have enacted extreme risk protection orders (ERPOs) since 1999. This webinar is a comprehensive primer about ERPOs, also known as red flag. The webinar will delve into the intricacies of ERPOs, including the mechanics of the law and case studies about how they have been used. ERPOs are judicial orders that authorize the removal of firearms from an individual who is deemed a danger to themselves and/or others. These judicial orders also prohibit the subject individual from acquiring and/or possessing firearms during the pendency of the court order. Here, the distinguished panel will address a variety of issues that are unique to ERPOs, including due process protections incorporated into ERPO laws and minor respondents. The webinar will also address judicial considerations from a judge who has adjudicated red flag law cases. Judges must have ready access to reliable information on red flag laws to address these cases in a fair, accurate, and efficient manner.
